The fight against slander, falsehood is on

This begins a series of a few articles to bring the readers of this newspaper up to date on the libel case filed in New York city, on March 15, 1994 by attorneys for Minister Louis Farrakhan and the Nation of Islam.

Minister Farrakhan and the Nation of Islam are the plaintiffs, in this legal matter. The defendants are N.Y.P. Holdings Inc., Publisher, New York Post; Rupert Murdoch, individually and in his capacity as Chairman, New York Post; Martin Singerman, individually and in his capacity as President, New York Post; Jack Newfield, individually and in his capacity as columnist, New York Post.

The attorneys for the plaintiffs have been and are primarily Minister Ava Muhammad, Minister Abdul Arif Muhammad, with help from attorneys Sister Barbara J. Emmanuel and Brother Larry Pershay.

The attorneys for the defendants is what has been termed--and in my view rightly so--the mega firm of Squadron, Ellenoff, Plesent, Sheinfeld & Sorkin, LLP.

What follows are words from written slander, called libel, against Minister Farrakhan and the Nation of Islam, in a document called a "complaint" without which the position (in this manner) of the Honorable Louis Farrakhan and the Nation of Islam could not proceed, in America's legal system, to begin the process to obtain "relief", compensation or, to put it more fully, that measure of justice which America can grant.

Paragraph eight, of the complaint, reads: "That on or about March 12, 1994, defendants published a front-page banner: 'WIDOW OF MALCOLM X FINGERS FARRAKHAN', followed by a page 2 banner: 'WIDOW PINS MALCOLM X MURDER ON FARRAKHAN.'"

Paragraph nine reads: "That the story contained, inter alia, the following statements with regard to Plaintiff Minister Farrakhan: 'Betty Shabazz, the Widow of Malcolm X, has accused Nation of Islam leader Louis Farrakhan of complicity in the assassination of her husband in 1965.' 'Do you think that Minister Farrakhan had anything to do with the death of your husband?' 'In the past, Betty Shabazz has been highly critical of Farrakhan, but had never directly said he was involved in the murder of her husband.'"

The tenth paragraph reads: "That the statements referenced in paragraphs EIGHT and NINE are defamatory per se as a matter of law in that: they are false; the actions attributed to the plaintiff constitute a crime punishable by law; the words connect the plaintiff Minister Farrakhan and the plaintiff Nation of Islam and its Mission and do them extreme harm, by referring to Minister Farrakhan in his capacity as a spiritual leader so as to impute criminal and immoral actions to him.

Paragraph eleven reads: "That the story contained, inter alia, the following statements with regard to Plaintiff Minister Farrakhan: "New evidence from FBI files has established that Farrakhan was in the Newark temple of the NOI at the hour Malcolm was assassinated in Harlem. He was supposed to be in Boston, where he was the chief minister. Farrakhan drove from Boston to Newark at 1:30 a.m. on February 21, 1965, according to FBI files. This is relevant because the four assassins named by Thomas Hayer--who is still in prison for the murder--as his co-conspirators were all members of the Newark mosque, which was allied with Farrakhan...Kenyatta told the Post on March 1 that former Fruit of Islam leader Yusef Shah admitted to him before his death last year that 'Farrakhan was personally involved in the planning of Malcolm X's assassination.'"

Paragraph twelve reads: "That the statements referenced in paragraph ELEVEN import further defamatory character to the words referenced in paragraphs EIGHT and NINE by innuendo.

"Since 1984, Defendants have had a history of malicious attacks against plaintiffs, and have engaged in a pattern of publishing false stories regarding the plaintiffs, that are totally void of evidence or reason.

"Plaintiffs know of no effort on the part of defendants to secure plaintiffs' position or point of view before printing the defamatory statements, particularly as they came from questionable sources. The subject matter of the article, in addition to being patently erroneous, is presented in a manner calculated to appear new and newsworthy, while it is in fact based upon the deliberate misuse of information that is nearly thirty years old."

The thirteenth paragraph continues: "That the subject news story exposed the plaintiffs to public contempt, disgrace, aversion and hatred, by planting the seeds of an unsavory opinion of plaintiffs in the minds of a substantial number of persons not limited to the metropolitan New York area."

The fourteenth states: "That the subject news story exposed the plaintiff Minister Farrakhan to physical harm and even death, by inciting persons who believed the defamatory statements to murder plaintiff Minister Farrakhan."

And in the fifteenth: "That the defendants were actuated by malice in that the defamatory words were published with the specific intent of causing the plaintiff Farrakhan to be discredited, hated, falsely imprisoned and to incite his murder."

As we will see in addition to the harm directly inflicted on Minister Farrakhan in particular, and Muslims in general, at least one member of the F.O.I. was murdered in connection with such written slander.

Paragraph sixteen, which we will return to in full later, identifies and describes the Honorable Louis Farrakhan, sums up his 40 plus year service to humanity and shows that he has earned his good name.

The seventeenth paragraph reads: "That by reson of the malicious actions of the Defendants, their agents, servants and/or employees, in printing the words complained of, plaintiff Minister Louis Farrakhan, sustained actual injury in the form of immediate threat of danger to his life, loss of liberty, severe damage to his character and reputation and anguish, all to his damage in the sum of Two Hundred Million, ($200,000,000) dollars."

The eighteenth identifies and describes the second plaintiff, Nation of Islam, and the nineteenth states, "That by reason of the malicious actions of the defendants, their agents, servants and/or employees, in printing the words complained of, plaintiff, Nation of Islam sustained actual injury in the form of immediate threat of danger to the life, liberty and character of its Leadership and the interference with the redemption and salvation of its members in the person of Minister Louis Farrakhan.

"That by reason of the malicious actions of the defendants, their agents, servants and/or employees, in printing the words complained of, individuals who constitute membership of Plaintiff Nation of Islam sustained actual injury to their character and reputation, harm in their professions and various fields of endeavor; because of their identification as members of the Nation of Islam, they are exposed to immediate threat of danger to their life and liberty as followers of Minister Louis Farrakhan, all to Plaintiff Nation of Islam's damage in the sum of Two Billion ($2,000,000,000) dollars."

The twentieth reads: "That defendant acted with malice regarding plaintiff Minister Louis Farrakhan, constituting punitive damages in the sum of Two Hundred Million ($200,000,000) dollars."

Then the twenty first states: "That defendant acted with malice regarding plaintiff Nation of Islam, constituting punitive damages in the sum of Two Billion ($2,000,000,000) dollars."

Finally this legal document concludes with: "WHEREFORE, PLAINTIFFS demand judgment against the defendants in the sum of FOUR BILLION FOUR HUNDRED MILLION ($4,400,000,000) dollars together with the costs and disbursements of the action."

As stated in previous Farrakhan: The Traveler articles, the Honorable Elijah Muhammad stated in February 1972: "Whenever you accused an innocent man of that which he didn't do the heavens and the earth cries out for justice for the innocent man. And the punishment he would have received if he was guilty falls upon the head of the the accuser."

He then said in response to the question of repentence raised by the Honorable Louis Farrakhan: "Yes Brother, repentance is accepted." And then he laid down the conditions under which such repentance would be acceptable: "If the accusation was open then the repentance must be open and it must be in time."

We will fight this case up to the United States Supreme Court, if necessary. We have absolutely no doubt that we will win this case, whether or not the United States legal system will not do justice by us, we are assured that Allah will, as indicated in the above quote from the Honorable Elijah Muhammad.

There are many instances that could be given that would serve as a indication of the basis of this assurance. One of these is that which is written in the book of James.

The fifth chapter of that book can easily be divided into three parts. The first part speaks to the wages which America held back from us who have worked to build up this country. I suggest that we all read the whole of that chapter.
